An Act to incorporate the Jules and Paul-Émile Léger Foundation, S.C., 1980-81-82-83, c. 85


 21. Subject to any by-law of the Foundation providing for the remuneration of officers, employees and agents of the Foundation, any profits or accretions to the value of the property of the Foundation shall be used to further the activities of the Foundation and no part of the property or profits of the Foundation may be distributed, directly or indirectly, to any member of the Foundation.


In both common law and civil law, the concept of "patrimoine" refers to a person's assets and liabilities. As this provision does not contemplate the distribution of liabilities, the French version should mention only the assets of the Foundation, as the English version does.


In the French version, the terms "son patrimoine" are replaced by "ses biens ou de ses bénéfices" .

 21. La fondation, sous réserve des dispositions du règlement intérieur prévoyant la rémunération et les indemnités de ses dirigeants, employés ou mandataires, affecte les bénéfices et plus-values provenant de ses biens à la promotion de ses activités; aucune partie de ses biens ou de ses bénéfices ne peut être distribuée, directement ou indirectement, à ses membres.
