Learn about services to facilitate compliance and enforcement of family support obligations
During the separation and divorce process, you and your former partner may agree to or be ordered to pay family support (child or spousal support). You must comply with your family support obligations whether the amount is set out in an agreement or a court order.
Definition:
A Court order is a written decision made by a judge. Parents must follow what the court order says. Court orders can be changed by going back to a judge and asking for a change, but only if there is a good reason.
While former partners should try to agree on their family support obligations, it is not always possible. If you need help to meet your financial support obligations or if your former partner is not complying with their family support obligations, you may need help from provincial and territorial services.
These services, such as provincial and territorial maintenance enforcement programs, can help facilitate the payment of family support obligations, or help you resolve support issues when your former partner resides in a different province or territory by obtaining an interjurisdictional support order.
Types of services
Maintenance enforcement programs
Provincial and territorial Maintenance Enforcement Programs (MEPs) can help facilitate the regular payment of child and spousal support. They can also help enforce payments when a parent or a former partner is not paying the support they owe. In some provinces and territories, MEPs also conduct searches to locate individuals, their employer, and their income and assets (locate services).
Interjurisdictional support
When you don't live in the same province, territory or country as your former partner, there are services that can help you to resolve family support obligation issues. All Canadian provinces and territories have reciprocal arrangements with each other and with certain other countries. These arrangements allow you to establish, vary or enforce a support order in a reciprocating province, territory, or country.
Each province and territory is responsible for making its own reciprocity arrangements. They each have an office that is responsible for processing interjurisdictional support cases. The office in your province or territory (frequently called “ISO unit” or “ISO office”) may be able to help you get or change a support order or have your support order registered and enforced in the place where your former partner lives.
If you and your former partner live in different countries and there is no reciprocal arrangement between your province/territory and the other country, check to see if the 2007 Hague Child Support Convention applies by visiting the Justice Canada webpage Enforcement between provinces, territories and countries.
Family law can be complex. You may want to get advice regarding your situation from a family law legal adviser.
For more information on provincial and territorial services that provide legal advice, please see the “Services that assist with the court process” section.
Definition:
A Legal adviser is a person who is qualified in a province to give legal advice to another person or represent them in court. This can be a lawyer, and in some provinces, may include other professionals.
