Figure 4.1: The Process of Divorce
This is a flow chart that attempts to show the process of divorce. The process consists of four stages.
Stage one is Marriage Breakdown.

Stage two is the Pre-divorce Petition where couples have the opportunity to go through Counselling/Reconciliation, Mediation, Legal Representation and Self-representation or make an application to the court. If their issues are resolved, the couple can either continue their marriage or enter into a separation agreement. If they are not resolved then the couple makes an application to the court which in turn issues. Provincial Court Orders. Once this is accomplished the couple makes a decision whether to divorce. If no, the marriage continues and if yes, they petition the court
- Stage three is the Divorce Action. Once one of the parties’ petitions the court, the respondent either agrees and with that consent or default a divorce judgement is made and the Judgement takes effect. If the respondent disagrees, the divorce action either continues through the courts to reach a decision via trial or the couple goes through a process of negotiation and mediation that results in a divorce judgement without trial.
